1. The website and the services

Visaya Capital operates visaya-capital.org as an informational and marketing platform for technology and information services connected with trading in cryptocurrencies and other financial assets. The site itself introduces the platform, collects registration requests, and publishes educational and legal information. Transactions in financial instruments, where executed, are carried out with the licensed legal entities and partners that provide the relevant services, under the terms of those providers. Using this site does not by itself create a brokerage relationship.

2. Eligibility and account use

You may use the site and register an account only if you are at least eighteen years old and legally capable of entering into binding agreements. You agree to provide accurate information, to keep your login credentials confidential, and to be responsible for activity under your account. One person, one account: duplicate registrations without our written consent are a violation of these terms.

3. Permitted use and restrictions

You may access the site for personal, non-commercial purposes connected with considering or using the platform. You may not interfere with the site's operation, and specifically you may not attempt to breach or test security without authorization; collect user data through automated means such as scraping or bots; overload the infrastructure through disproportionate automated requests; or use the site to distribute spam, malware, or unlawful content.

4. Intellectual property

The site's design, texts, graphics, logo, and code are the property of Visaya Capital or its licensors and are protected by intellectual-property law. You may quote short passages with attribution and a link, but you may not reproduce substantial parts of the site, or use its marks, without our written permission. Nothing on the site transfers IP rights to you beyond the right to use the site as intended.

5. Marketing materials and newsletters

Where you opt in, we send informational emails about the platform, market education, and service updates. Every marketing email contains an unsubscribe link, and unsubscribing takes effect immediately for future campaigns. You may also withdraw consent by writing to [email protected]. Transactional messages about your account, such as security alerts and withdrawal confirmations, are not marketing messages and are sent regardless of marketing consent.

6. Privacy

Our handling of personal data is described in the Privacy Policy, which forms part of these terms. By registering, you agree that your data is processed as described there, including for identity verification under our AML / KYC policy.

7. Third-party links

The site links to third-party resources for your convenience, such as payment providers' help pages. We do not control those sites and are not responsible for their content, availability, or data practices. A link is not an endorsement of everything a destination site contains.

8. Prohibited uses

Without limiting section 3, you may not use the site or platform for unlawful purposes; to launder proceeds of crime or finance terrorism; to infringe the intellectual-property or privacy rights of others; to attack, probe, or disrupt our infrastructure or that of our providers; to impersonate any person; or to assist any third party in doing any of the above. Violations lead to suspension, and where required, to reporting to the competent authorities.

9. Support

Support is available at [email protected] during Monday to Friday, 9:00–18:00 PHT (excluding public holidays), with a first reply usually under one business hour. Support can help with account matters, deposits and withdrawals, platform settings, and complaints. It will never ask for your password or one-time codes, and any message that does is not from us.

10. Disclaimer of warranties

The site and its content are provided on an "as is" and "as available" basis. While we work to keep information accurate and current, we do not warrant that the site will be uninterrupted, error-free, or complete, and we do not guarantee the accuracy of market data shown on it. Nothing on this site is investment advice, a recommendation, or a promise of results. Trading involves risk, including loss of capital, as described in our risk disclosure.

11. Limitation of liability

To the maximum extent permitted by applicable law, Visaya Capital is not liable for indirect, incidental, or consequential damages, or for lost profits, arising from your use of the site. Where liability cannot be excluded, it is limited to the amount of fees you paid to us for the service in the six months preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.

12. Indemnification

You agree to indemnify Visaya Capital against claims, damages, and reasonable costs arising from your breach of these terms, your violation of applicable law, or your misuse of the site or platform, provided we notify you promptly of the claim and cooperate reasonably in its defense.

13. Changes to these terms

We may update these terms as the service or applicable requirements change. The updated version takes effect when it is published on this page. If a change materially reduces your rights, we announce it in the dashboard before it takes effect. Continuing to use the platform after the effective date means you accept the updated terms; if you do not accept them, you may close your account and withdraw your funds.

These terms are governed by the laws of the Philippines, without prejudice to mandatory consumer-protection rules applicable to you.
